We booked a hall for our wedding a year in advance. My fiance gave the hotel my credit card number over the phone to hold the date.we were emailed the contract 3 weeks later.By then the cost of the hall and food had been raised some 30% from what we were orginally told.We never signed the contract and told the hotel we were going somewhere else. Then she said we couldn't get our deposit back untill someone books the room.As of last week no one has taken the room. So am I screwed out of $1000?Thanks for any help

Most places have in the contract that the price you sign for will stay the same, look over the contract, if it doesn't say anything still fight! Customer service right? Also try going to the BBB

Well, honestly, I think you are out the $1000 because you never signed a contract ensuring you would be paying the price at the time of reserving the hall. Sorry about you luck.

If you signed a contract, then the food prices should have been part of it and they should have to honor those original food prices. ALSOIf you never signed the contract, then there is NO contract. Only an oral contract. While an oral contract is binding, they have already breached it by raising the prices. Contact your credit card company and report fraud as well. Worst case, take them to small claims. You should win

Contact your credit card company. If you gave them several months notice the credit card Company might refuse to honor the charge. I don't know, but it's worth a try. Also, you might want to contact a lawyer.

Generally, this is how it works. This is the reason why the venues make people do this. They need to save their butts if someone cancels. If they can't fill the date, that's lost money. The only thing I could think of is to find another couple. Try you local Knot Boards (Theknot.com) and just write a messages saying you canceled your wedding at this location, but would like to have the spot filled by another bride, so you don't get screwed out of $1,000.Since the prices had changed prior to the signing of the contract (which makes sense with the rising food and gas costs), there isn't much you can do.You've learned a valuable lesson. It's always best to sign the contract when you give the deposit. If you had signed it, you could have locked in the price of the food and the venue could not legally charge you the 30% increase (unless, it said prices were subject to change in the contract) You waited 3 weeks to sign the contract and the prices changed.

I would talk to my credit card company and say that they raised the price it was not something you agreed upon and they still took 1000 out and the credit card company will do everything for you. There is no need for you to raise your blood pressure, let them do it for you.

have a lawyer contact them, or at least tell them you will for breach of contract. the contract they sent you were not on the terms of which you agreed so therefor the same rules do not apply for the deposit. if they dont believe you...any lawyer will gladdly assist you.good luck!

I think you should contact a small claims court about this. I would like to think that if you haven't signed the contract that they should not be able to hold your money. Question... In the contract does it say anything about the price that you were told at first because if so then you should've been able to hold the hall for that price and no other even if the price did go up!!!! Check into that!!!!!

Yep. You are out of luck. You should have waited for the contract to hold the date. The good news is that if it is a popular hotel, likely someone else will take the room.

I'm no lawyer. But it seems to me that the terms of your oral contract were changed (the price increased). On those grounds I think that you should probably be entitled to a full refund. Unless they mentioned on the phone that there was a chance of that happening. If that's not the case, you should demand your money back. What I wonder is why you didn't finish paying before the price increased?Any way, them waiting for some one els to take the room has nothing to do with you. You were given a price, you agreed to the price, you put down a deposit, then THEY changed the price. It looks like the old "bate and switch" to me. You shouldn't stand for it. Do everything you can. Threaten them. "IT'S YOUR MONEY, AND YOU WANT IT NOW!" |
