I contracted with a photographer to do my friends's wedding. Because the photographer provided additional services for paying the entire amount up front, we paid $2,450 in order to get these additional services. Unfortunately, my daughter's fiance has been called up to active duty and we have postponed the wedding. I wrote the photographer asking for a refund, less any cancellation. He responded that the entire amount was the cancellation fee. I'm trying to find a copy of the contract we signed, but does anyone see anything on the surface of this which would preclude him from charging such an onnerouse fee?

I would advise you to let him know that the State attorneys represent ANY active duty member of the service! I would let him know that unless he wants to involve JAG attorneys in these case he should either let you move the date to a later one when the groom will be home or he should refund the entire amount if you have given him more than 30 days notice.
Let him know if he needs it you can provide him with a copy of the Active Duty orders that states if anyone attempts to take advantage of the situation they will be prosecuted to the fullest extent of the law!!

That sounds really fishy to me. I know people might tell you that they booked the date and possibly didn't take other offers. But you're paying them to sit around and do whatever they want.

And I'd follow the advice above me. Even if the photographer is technically right, who wants to go to court against someone serving his country?

I would transfer what they have paid to another date. However, client would have to work with the photographer once they reschedule their wedding, due to availability. I have done that in the past. For a flat out cancellation I would return all monies except for the retainer, which is usually 1/3 of the total amount, (After all, more than likely business has been turned away). Then I have them sign a "Nullification of Agreement" releasing all parties from the origional agreement.
