ok so my husband owns a video productions company and i work with him. basically, we videotape mostly weddings, we do commercials, seminars, music videos---anything people want taped. with weddings, there comes a time when two brides inquire for the same date. so my husband does his own wedding, and i do my own. then sometimes, another bride asks for the same date. we didnt want to turn down the money so we needed to hire someone. then an old friend of his called him up one day and wanted to have a business dinner and basically, he wanted to start his own videp production company too and wanted to learn from my husband. so my husband agreed. he said he'd train him. this friend of his owns a tuxedo store so lots of potential clients. so my husband basically taught him the tricks with videotaping, the style we want, my husband also helped him with the type of equipment, etc. but he has more money so he has more expensive stuff than we do. and now, he is doing a few weddings now.now that he is doing his own weddings, he is also using our style, he even tried to make his own website and prices based on ours, and yes my husband knows of it and he asked permission and my husband agreed. its kinda hard to say no.so how do u handle this? he is basically a competitor now. but he is using our style and is still freelancing for us. he is a good guy and all but i dont want my husband's business to go down just because some amateur does the same work like us. videography is an art too and thats what we get paid for. my husband has over 20yrs experience on this and this new guy's only experience is selling tux to wedding clients. how do u handle this?!?!how much commission should we ask then? what if they totally say no? what does this non-compete agreement thing do? like, what are its limits? my husband is always trying to learn new things. he spends hours on the internet watching competitors work and trying to learn off of their mistakes and styles. and here we are, just handing it over to his friend. i just feel bad for my husband. he doesnt feel the same way about it but in our marriage, when i worry about something, i always end up saying, "i told u so" and i dont want to do that since we are self-employed! its too big of a risk!i mean, do u think im just being paranoid? is what my husband doing ok and i shouldnt worry about it?

you are having an expensive lesson [the lost business].when you bring someone into your business and teach them how to do it, one of the things you want to get is a non-compete clause in the employment agreement. And you need to have an attorney draw it up since what is an enforceable non-compete clause differs from state to state [or country/province].

Make all people who you are going to train first sign a Non-Comp (non-competition agreement)...

If you train anyone to video tape the weddings for you, then you need to have a non-compete clause in their employment contract.You need to consult a lawyer to get the details. But you should restrict the employee from going out on his/her own within a certain mile radius, for a certain amount of time, and prohibit them from contacting any of your clients for a certain amount of time also.

Your employees need to sign a Non-Competition Agreement. It's hard to decide on what exactly to do. Your husband did give your friend the ok to do it. But maybe you should go up to him to clarify the situation. Explain that you do not want him to use "your style" photography. That is about all you can do.

I cant tell you much but to step your game up. upgrade equipments, learn more stuffs, join an organization and learn something unique that if he wants to use, he gotta pay you extra commission.

Some companies have a pre-employment contract. But I look at it this way . If an worker wants to progress and learn he is doing a much better job than a person with an interest in leaving for more money in a different job. If we have a growing economy it is healthy. Don't sweat. Hubby can hire out to him also now.

its simply business you both want to succeed unfortunately you shouldnt have taught someone your trade. even turning down one wedding is better than losing your trade to another client ie: your friend.you will just have to do your best to provide a better portfolio, service so you get the trade before your friend does. the more your known for being the best at reasonable prices the better you will do
