| I had a makeup trial and paid the lady a deposit to book her for my wedding day. I changed my mind but the lady says that I can't have my deposit back. It does say on her website that deposits are non-refundable, but she didn't tell me this at the time and I have no written contract. Does she have to give it back to me? |

| There are a number of elements that make up a contract, but being in writing isn't one of them. It sounds as though a valid contract existed between you and the make-up lady, but you have broken it. She is entitled to keep the deposit to cover the inconvenience and the chance that she will not be able to find an alternative customer. If the deposit is more than about a fifth of the total cost, it might be considered excessive and you could claim back anything above that amount, but you'd probably have to take her to court and there's no guarantee you'd win. |
