| I know there are alot of factors but i would like some info and help. I have some friends who were having a pre-wedding party and they had fireworks, well the cops showed up and wanted the fireworks and whoever was responsible. My friend who had been drinking started arguing with the police and one thing led to another and they wanted to arrest him for being drunk even though he was in his own backyard. My friends family tried to stop the cops from doing this so they grabbed him andtried putting him in the house before the cops could get him but that didnt work. So long story short one kid hit a cop while the groom, his brother, dad and bride to be all ended up arrested for felony resisting. The groom has an added charge of kicking out the back window of a squad car. None of them have any priors and they are respected members of the community (Small county, really small town). Bail was set, 200,000 each b4 they see a judge. Will it be bumped to misdemeanor? Will 4 days be time sevred? |

| Anyone who punched a cop can expect the charge to be battery on an officer. The one who kicked out the window can also expect the be treated harshly. In my county I would expect about 4 months for the window kicker and about 6 months for anyone that punched a cop. Those who merely refused the orders of a cop can expect time served. |

| If that is all that was done or charged (like there was no assault on the officer or no attempt to take a gun or anything, just resisting, obstructing or delaying an officer), it is a misdemeanor violation of Penal Code section 148 with a maximum of $1000 fine (but then they add penalty assessments which makes the maximum fine total around 2500) and or up to one year in the county jail or any combination thereof.If that is all that was done or charged (like there was no assault on the officer or no attempt to take a gun or anything, just resisting, obstructing or delaying an officer), it is a misdemeanor violation of Penal Code section 148 with a maximum of $1000 fine (but then they add penalty assessments which makes the maximum fine total around 2500) and or up to one year in the county jail or any combination thereof.Most common 148 places the individual on probation with some jail time (less than a year) and a fine (less than the $1000).1 year ago However it is a felony to assault and cause battery of an officer. Looks like someone will be spending some time if jail.
