My fiance and I have been planning our wedding for a little while now and we finally came upon a very unique and eccentric restaurant to do our reception. We fell in love with it and scheduled an appt to meet with someone to see the banquet rooms and talk about pricing. When we met with the lady, she gave us a rush around of the restaurant and a quote in less than 5 minutes. She informed us that the owner was on vacation until July 14th and we would have to wait until then to book the reservation because we would need to speak with her and get her permission because she has "already turned away two same sex couples" and that it's "a family restaurant and she chooses not to run her business that way". Then she said, with a grin, "I'm sure this will happen alot to you, don't take it personally"; Among several other remarks.Now I know businesses have "the right to refuse business to anyone" but these were different circumstances. I'm hurt, pissed, and pretty stunned. Any legal advice?

try to find some other place to have your event. why would you want to have it there anyway if that's what she's going to say to your FACE -- imagine what they would do to you behind your back!! spit in food, etc. eeek

The best legal advice I can give on this subject is to talk to an attorney. Or offer to rent the entire establishment all evening (afternoon, etc) so they can post a sign stating that it will be closed from such to such for a private party. But I honestly am not sure if you can do anything. Even fi you could, they could make it so uncomfortable for you (like playing christian stuff) that it might not be your best bet.

Yeah, I hear you.But, remember MLK....the struggle you are encountering is a lot like his. You getting married is a great, big step for social equality. Don't raise tempers, just go somewhere else.I wish you the best =)

If I were you, I would not try and make this a legal issue. I'm not saying this woman was not completely out of line, I just don't see the advantage for you or your partner. Focus on the fact that you are getting married, not on this small-minded woman's bigotry. Write a well worded letter of complaint to the restaurant's owner. I think what you want here is to let the owner of the establishment know how you feel, and to do it while taking the high road. You could also try writing to the local paper's editorial section, it would only be fair that the community know that this particular establishment is not welcoming to the gay community, and do not deserve their patronage.

I am so sorry you and your fiance had to face that discrimination. As for legal advice I couldn't give that to you, but personally if I was you I would look for somewhere else. Than let every one you know about the way you was treated at that first restaurant. Word of mouth can be a powerful tool. I wish you and your fiance best wishes, congratulations and I hope you have a happy healthy long life together. Just remember you are better than the weak minds of the people that run that restaurant.

Unfortunately, unless this venue receives state or federal funds, it can legally refuse to hold your wedding. There is no right to be a patron at an establishment unless that establishment receives state or federal funds. (Once they do this, then you can can claim state action and sue under the 14th Amendment.) This has actually been happening a lot in CA since the decision making it permissible for homosexuals to marry. Many vendors, including florists/bakers/etc. are not comfortable with the idea of same-sex marriages and are refusing the opportunity to service these events. I think, in time, they will come around. I would say to not even waste your money on a venue that doesn't seem to want you. It's their loss!Congratulations. Very exciting times!
